General Conditions of Purchase

Please read the following General Terms and Conditions of Purchase carefully before using our services:

 

I.- Scope of application

All contracts, purchases of products and services shall be made in accordance with these terms and conditions. These general conditions of purchase shall apply to all future transactions without the need for a new express agreement.

By placing an order, the customer agrees to be fully bound by the purchase contract, set out in these terms and conditions, with Argot Flamenco.

Argot Flamenco offers the marketing of its products and services in the European Union. However, if a user is interested in receiving an article outside the European Union, he/she should contact Argot Flamenco through the contact forms available on the website or by sending an email to [email protected], we will study the request and inform him/her about it.

Argot Flamenco may periodically modify these General Terms and Conditions of Purchase, the latest version of which may be consulted at any time on this website.

 

II.- Communication with the client

When placing the order, the customer must indicate at least one email address, the operability of which must be ensured from the moment the order is placed until the completion of the order. In particular, the customer must check the settings of his spam filter (locally and/or by his email provider) and check that he receives email from Argot Flamenco. This email address can be used for future orders as long as the customer does not modify it or request its change or rectification.

Messages from Argot Flamenco that are sent by e-mail to the indicated e-mail address are assumed to have been received by the customer after they have been sent. Argot Flamenco is only responsible for possible transmission errors if they are based within the scope of Argot Flamenco. The client has the option to provide evidence of not having received the message through no fault of his own.

Argot Flamenco is not obliged to notify the customer of errors, faults or inoperability of the email account. However, the customer is allowed to provide evidence that it would have been technically possible and reasonable for the message to have been received.

 

III.- Performance of the contract

In the purchase of a product or service by the customer, in the event that the customer provides a different delivery email address (for example, when purchasing products or services for someone other than himself), this circumstance will not affect the execution of the contract with the customer. However, if the customer is acting on behalf of and in the interest of a third party, the contract will only be binding on the latter when this circumstance is proven and made known to Argot Flamenco, and when Argot Flamenco expressly agrees in writing to enter into the contract with this person. In all other cases, the provision of a different delivery e-mail address will not affect the execution of the contract with the customer.

 

IV.- Acquisition

To purchase any of our services, you must select the specific service you wish to purchase, check the description and services included and click on book, once you have included the information on the date and number of people who wish to enjoy it.

You must then follow the steps that are indicated. These are:

1. Provide us with your personal details in order to be able to carry out the contract.
2. Indicate the method of payment: Bank card is the accepted method of payment (although in exceptional cases, bank transfers may be arranged with the authorisation of Argot Flamenco).
3. Confirmation of the purchase and sending of your confirmation document to the email address you indicate.
4. Show your Confirmation Document (on your mobile or printed) to the person in charge of Argot Flamenco at the place and date confirmed and you will be able to enjoy your purchase.

Before acquiring any of our services, the client must bear in mind that:

 

V.- Prices, Means of Payment and Invoicing

All product prices shown on the website include VAT and any other taxes that may apply. Only the shipping costs must be added to the final price of the product.

The accepted means of payment are: Payment by credit card, bank transfer and Paypal

- Bank transfer: If you select this method of payment, once you finalise the order, our bank details will appear for you to make the transfer.

In the Concept of the transfer must indicate the order number and the name of the person making the purchase. This payment system will not entail any additional charge for the customer.

The order will not be considered effective until the corresponding payment has been confirmed and, therefore, the shipment will begin once the payment has been received in our account.

- Payment by credit card: You can pay with your credit card, free of charge. Your credit card will be charged at the end of the order and the payment will be validated immediately. The payment process has the highest security measures commercially, and works on a secure server using the SSL protocol (Secure Socket Layer).

- Payment by Paypal: You can pay with your account or with your credit card through Paypal free of charge. Your credit card will be charged on completion of the order and the payment will be validated immediately. The payment process has the maximum security measures commercially, and works on a secure server using the SSL protocol (Secure Socket Layer).

The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, which ensure that it is only intelligible to the Client's computer and that of the Website. In this way, by using the SSL protocol, it is guaranteed:

1. That the Client is communicating his data to the Argot Flamenco server centre and not to any other that might try to impersonate it.
2. That between the Client and our server centre the data is transmitted encrypted, preventing its possible reading or manipulation by third parties.

The Customer undertakes to pay at the time of placing the order.

The proof of purchase corresponding to the purchase order will be sent immediately after confirming the order. If you have lost it, you can ask us for a duplicate using the contact details indicated in this document.

The Customer must notify Argot Flamenco of any undue or fraudulent charge on the card used for the purchases, by email or telephone, as soon as possible so that we can take the appropriate steps.

Argot Flamenco will send invoices exclusively by e-mail. The customer agrees to this method of invoice transmission. The invoice does not stipulate the due date of the invoice.

 

VI. Formalisation, cancellation of purchases and liabilities

Once the order has been placed, i.e. with the acceptance of the General Conditions of Purchase and the confirmation of the purchase process, we will always send an email to the Customer confirming the details of the purchase made.

Argot Flamenco. will accept cancellations of orders under the conditions indicated below. To make a cancellation you must request it through the forms available on this website or by sending an e-mail to [email protected]

Argot Flamenco. shall not be liable for any errors caused in the delivery when the data entered by the Customer in the order form does not correspond to reality or has been omitted.

The Customer must check that all the purchase details are correct, once the purchase has been confirmed. If you find any errors, you must notify us immediately so that we can make the necessary corrections. Argot Flamenco will not be responsible for any errors made by the customer when selecting the product and the desired date.

Each delivery is considered to have been made as soon as the product is made available to the customer by the carrier, as evidenced by the control system used by the carrier. It is up to the recipient to check the order at the time of delivery and then make any reservations and complaints that may appear justified, including the possibility of refusing the package if it has been opened or if there are obvious signs of deterioration.

Consequently, the customer shall only be entitled to claim for imperfections when he has fulfilled his obligations of examination and complaint of errors, provided that he exercises his action within 24 hours after the confirmation of the purchase, and always at least 24 hours before the date confirmed on the faulty product. Once this period has elapsed, the customer shall lose any right to claim and the product shall be deemed to have been received in full conformity.

 

VII. Guarantee

Our articles are guaranteed for the period indicated in the legislation in force and in the instructions detailed by the manufacturer of the product.

 

VIII. Returns

Returns will not be accepted unless they come in their original packaging and with the product in perfect condition, except in the case of defective goods.

Claims for possible incidents such as the product being delivered damaged, wrong, or for any other cause susceptible to complaint, will be dealt with in the following way:

Argot Flamenco undertakes to deliver another product in perfect condition and collect the defective product. In the event that it is not possible to exchange the product for the same product reference, the customer will be refunded the full amount paid in advance.

In case of return of a product (as long as it is not defective), the transport costs for both delivery and return shall be borne by the buyer, as well as all bank charges incurred.

In order to exercise your right of withdrawal, you must do so within 14 calendar days of receipt of the product.

The refund will be made in the form of a credit note. For any other incident or complaint we advise you to contact us on our telephone line 670 71 53 10 or at the following email address: [email protected].

The delivery note is valid as the manufacturer's guarantee, which takes effect from the day of delivery to the buyer's address.

The invoice corresponding to the delivery note will be sent by email approximately 7 days after the delivery of your order. If you are not satisfied with Argot Flamenco products or services, you may return them within 7 working days of receipt of the product. Returns must be sent together with the delivery note.

 

IX. Complaints

If the customer considers that their rights as a consumer are being violated or not attended to, they can file a complaint with the Consumer Office of the Andalusian Regional Government (Junta de Andalucía). To do so, and if you have a digital certificate, you can make the complaint on the website of the aforementioned Consumer Office. If you do not have a digital certificate, you must submit your complaint in person at our establishment or at any of the consumer offices set up for this purpose.

At the same time, it is possible to resolve complaints between us and users through consumer arbitration.
